Non-compete/solicitation language is becoming more and more prevalent as employers seek to prevent employees from "jumping ship" after the employer has invested significant resources in their training and development. These types of clauses must be drawn with sufficient breadth to be effective, but must also not overreach, which could result in a Court of law deeming the language to be unenforceable. Contrastingly, employees must know and understand their rights and potential liabilities under such clauses.
