Compensation You May Receive from a Hernia Mesh Lawsuit

A product liability case allows you to pursue fair compensation for several damages. Your potential compensation depends on the unique nature of your injuries, such as your recovery process.

Your Medical Expenses

You can seek compensation for any surgeries, medical procedures, hospitalizations, and medications you require to get better. Other medical expenses may also warrant damages.

Awards for ongoing medical care may also apply. We can discuss your recovery outlook with your doctors and other medical experts to determine your future medical expenses.

Lost Wages

You can seek compensation for lost wages, bonuses, benefits, and paid time off. We can look into your wage statements to determine how much you stand to recover.

Reduced Earning Capacity

If your hernia mesh injuries prevent you from ever returning to work, you might be worried about how you will support your family. We can seek reduced earning capacity to make up for the income you would have earned over the years.

Even if you can perform some of the same work duties, you could still qualify for compensation to make up the difference.

“Pain and Suffering” and Inconvenience

You can seek awards for the physical pain and emotional anguish your hernia mesh injuries cause.

Loss of Quality of Life

You may never be able to enjoy the activities you once did after suffering injuries. A permanent disability can also make daily tasks difficult. You can seek loss of quality of life if you experience such losses.

Wrongful Death Damages

Through a wrongful death lawsuit, you may recover:

  • Funeral and burial or cremation services
  • Your loved one’s medical care
  • Your loved one’s “pain and suffering” and inconvenience
  • Loss of inheritance

We can handle your case while you honor their memory in peace.

Types of Hernia Mesh Products Available to Patients

Hernia mesh products are either biological or synthetic. Biological products are made from animal tissue, while artificial products can contain a variety of potentially dangerous ingredients, like polypropylene (PP), expanded polytetrafluoroethylene (ePTFE), and polyester (PET). Synthetic mesh products can be absorbable, non-absorbable, or a combination of the two.

Each type of mesh material has its own advantages and disadvantages, but Membranes (Basel) shows that all hernia mesh products could pose complications.

Hernia Mesh Complications Can Overshadow Their Benefits

Though hernia mesh repair can be effective, serious medical complications can result. Defective mesh products may require additional surgeries, putting patients at greater risks. Doctors should weigh the benefits and drawbacks before suggesting this treatment option.

Hernia Recurrence

The U.S. Food and Drug Administration (FDA) found that any type of hernia mesh product can fail, leading to hernia recurrence and the need for additional surgeries. Engineered Regeneration found that absorbable mesh products have a higher rate of hernia recurrence than non-absorbable ones. Additionally, synthetic mesh products had a lower rate of hernia recurrence than biological ones.

Chronic Pain

The British Journal of Surgery notes that hernia mesh products often result in years of chronic pain. RadioGraphics found that some patients even suffered debilitating pain and required immediate hernia mesh removal. This symptom can last a long time, as well, as patients reported worsening pain three years after their hernia repairs.

Mesh Migration and Adhesion

The Clinical Journal of Gastroenterology notes that hernia mesh products can migrate, shift, and adhere to other organs, causing bowel obstruction and inflammation. For example, a mesh product used to treat an abdominal hernia could migrate and attach itself to the intestinal walls. In some cases, bowel perforation occurs, which can be extremely painful and life-threatening.

Mesh Erosion and Infections

According to Engineered Regeneration, non-absorbable mesh products usually carry a high risk of erosion, leading to infections. As the mesh material shrinks, bacteria proliferates in its pores. Some manufacturers coat their mesh products with antiseptics to combat infection risk. Still, Surgical Infections reported that infections can still occur with coated products.

Mesh Rejection

Some patients may be allergic to hernia mesh materials, triggering their immune systems to reject the mesh product. This can result in severe swelling, tenderness, and flu-like symptoms, according to Trends in Urology and Men’s Health.

Seromas, Hematomas, and Abscesses

According to Diagnostic and Interventional Imaging, hernia mesh products can also lead to fluid collection, such as seromas, hematomas, and abscesses. These conditions could worsen into sepsis, which can be life-threatening. Fluid collection can also cause fevers, chills, and rapid heart rate.

Hernia Mesh Removal Procedures That Are Available to Patients

When hernia mesh products fail or lead to complications, doctors might have to remove them. They may do this through surgery, endoscopic mesh retrieval, or laparoscopic mesh removal.

Doctors might have to remove them when hernia mesh products fail or lead to complications. They may do this through surgery, endoscopic mesh retrieval, or laparoscopic mesh removal.

These are dangerous, invasive procedures that put patients at risk of further medical complications. Hernia: the Journal of Hernias and Abdominal Wall Surgery noted that some patients even need feeding tubes after hernia mesh removal.

As prominent as hernia mesh repairs are, the American College of Surgeons journal notes that hernia mesh removals are becoming more and more frequent.

Hernia Mesh Manufacturers Face Liability for Defective Products

In recent decades, hernia mesh manufacturers have had to recall their products due to their risks for complications. In 2006, the FDA issued a mandatory recall of Proceed Surgical Mesh after patients suffered bowel perforations. In 2016, it also issued a recall for Ethicon Physiomesh Flexible Composite Mesh for its high hernia recurrence rate.

Currently, Ethicon Inc. and/or Johnson & Johnson and Davol, Inc./C.R. Bard, Inc. are facing multidistrict litigation (MDL) for defective product design, manufacturing, and labeling, along with other allegations.

These product liability cases involve accusations of:

  • Designing an unreasonably dangerous product
  • Negligently manufacturing their products
  • Failing to warn doctors and patients about the risks associated with their products
  • Failing to comply with consumer protection laws
